Student Guardian Visa (590 Visa)

The Student Guardian Visa (Subclass 590) enables individuals to reside in Australia as the legal guardian of an international student who is under 18 years old and studying in the country on a student visa.

  • Relationship Requirement: You must be either the parent or legal guardian of the student or a relative who is 21 years of age or older and has been nominated in writing by a parent or legal guardian of the student. This requirement ensures that you have a close relationship with the student and are responsible for their welfare.
  • Age Restriction for Family Members: Generally, you should not bring family members younger than 6 years of age with you, unless there are exceptional circumstances. The intention is to ensure that the visa holder can effectively fulfill their role as a student guardian without the additional responsibility of caring for very young children.
  • Financial Support: You must have the ability to provide accommodation, general welfare, and other necessary support to the student during their stay in Australia. This includes covering their living expenses, healthcare, and education-related costs. However, if you are applying for this visa with the support of the government of your home country, you may be exempted from this requirement.

If you are applying for the Student Guardian visa in Australia, you must currently hold a valid temporary visa, excluding the following visa types:

  • Domestic Worker (Temporary) – Diplomatic or Consular visa (subclass 426)
  • Temporary Work (International Relations) visa (subclass 403) in the Domestic Worker (Diplomatic or Consular) stream
  • Diplomatic (Temporary) visa (subclass 995) – only the primary visa holder. However, family members of a Diplomatic (Temporary) visa (subclass 995) holder can apply for a Student visa in Australia.
  • Transit visa (subclass 771)
  • Visitor visa (subclass 600) in the ‘Sponsored Family’ stream or the ‘Approved Destination Status’ stream.

A substantive temporary visa refers to any visa other than a bridging visa, criminal justice visa, or enforcement visa. It allows the visa holder to stay temporarily in Australia.

  • Children under six years old can only accompany you if there are compelling and compassionate reasons or if their visa would strengthen the relationship between the Australian Government and another country. In the latter case, you must be at least 21 years old and the student must have written support from a parent or custodian.
  • Both you and the child must meet the health requirements, and the child must have health insurance for their stay in Australia.
  • Children aged six or older must apply for their own student visa if they wish to accompany you.
  • Be a parent, legal guardian, or a nominated relative aged 21 or older, as designated in writing by a parent or legal guardian of the student.
  • Unless there are specific circumstances, do not bring family members below the age of 6.
  • Demonstrate the ability to provide accommodation, general welfare, and necessary support to the student, unless applying with government support from your home country.
  • Additionally, you must:
  • Meet health and character requirements.
  • Have sufficient funds to support yourself, any accompanying dependents, and the student.
  • Possess adequate health insurance for yourself and any accompanying dependents.
  • Not have any outstanding debts to the Australian government, or have made arrangements for repayment.
  • Maintain a temporary stay in Australia.
  • Provide biometric information if requested
